If anything, calling the data plan that US carriers give "unlimited" is definitely false advertising when you consider you have to read the fine print to fully understand all of the terms. Regardless of whether the text is there or not, qualifying terms in subtext has already been proven a big "no-no" in other types of contracts by the courts and Congress (like the recent bill on credit card contracts).
