I think the greatest concern to most people is that they may have running contract with another GSM based carrier like T-Mobile.
The second issue with the AT&T 2 year agreement is that you have to pay much more for the "iPhone data plan" than for the typical unlimited smartphone data plan. It is the EXACT same service, only more expensive. This is obviously offensive.
@slamEVIL: Based on my own experience trying to terminate my AT&T line for my IPhone 3G 8GB. My guess is that it became so common for people to sign contracts only to terminate them and go jailbreak/unlock their iPhone's that AT&T have added safeguards. AT&T will claim it is a Apple requirement that the device must be returned on contract termination but I found that Apple in reality couldn't care less. I managed to close my contract without returning the phone by having a Apple Store sales representative call AT&T customer service and state that he did not want to have my "lost" iPhone back.
If you google "iPhone + early termination" you will see a few threads on this, both with regards to AT&T but also European iPhone exclusive carriers.
AT&T will typically require you to return the device if you cancel within the time of the two year agreement. Only way around this is to say the device was lost or stolen and that you do not want to replace it or transfer service etcetera. The device will cost you about $600 before you are free from AT&T's claws.
This HTC clone is about 5 years too late, isn't it!? I have been a user of the N95 8GB and I'm currently sporting the E71: while I adore the quality of Nokia devices, I absolutely despise the laggy and not very customizable S60 OS. Nokia needs to pull a SonyEricsson: as when they ditched UIQ to go Windows Mobile... Symbian may work for low end feature phones but it sucks on prosumer and business devices...
